Paul W. Taylor has defended a life-centered ethics that considers the inherent worth of all living things to be the same. l examine reasons for ascribing inherent worth to all living beings, but argue that there can be various levels of inherent worth. Differences in capacities among types of life are used to justify such levels. I argue that once levels of inherent worth are distinguished, it becomes reasonable torestrict rights to human beings.

The article examines the question of whether business ethics courses ought to have an impact. Despite the still common attitude among students and some business professionals that ethical considerations are less pressing in business, I argue that moral obligations are just as important there as elsewhere. The emphasis on profits in business is related to other realms (e.g., hobbies and seeking and education) in which, though private goals are dominant, moral limits remain in force. The paper seeks to explain rights by first uncovering their specific place in the moral realm. Accounts of rights as claims or entitlements are criticized for attempting to explain the moral concept of rights in terms that are primarily non-moral. Rights are then described as a form ofprescriptive presumption, that is, as requirements on deliberations that yield justifiable expectations of certain types of treatment. This is an introductory text for an ethics course that provides the theoretical background for discussion of ethical problems.

We develop a vision of consumer responsibility in purchasing decisions in light of the Coalition of Immokalee Workers’ boycotts. These boycotts succeeded in convincing large fast food companies and national supermarket chains to pay tomato growers a penny more per pound, to improve working conditions and wages for pickers. The C.I.W. efforts to generate consumer support eschewed claims associated with rule-based obligations in favor of appeals more typically associated with virtue and caring ethics. The strategies encouraged consumers to understand the (...) plight of tomato pickers and to extend concern in an effort to improve the world. These strategies are associated more with encouragement to contribute to the social good rather than claims that in refusing to help, consumers would fail to fulfill an obligation. Insights from virtue ethics and caring ethics are offered as a model for a broader account of consumer social responsibility. (shrink)

The latest book by Louis Dupré, The Quest of the Absolute, is the third and final volume of a trilogy on the intellectual history of modernity. It follows Passage to Modernity (1993) and The Enlightenment and the Intellectual Foundations of Modern Culture (2004). Elegant writing and remarkable erudition go hand in hand with a deep insight into the objectives, achievements and deadlocks of the Romantic movement. It is not possible to look into the overwhelming variety of issues and figures (...) that come to the fore in this book and the trilogy as a whole; instead, this article focuses on Dupré’s central claim as to the development and significance of modern Western culture, starting from a specific question that time and again recurs as a key motive throughout the three volumes of his trilogy: are we postmodern or late modern? Dupré’s answer that we are dwellers of a late modern era rather than inhabitants of a postmodern age is dependent on his definition of modernity as a still ongoing ‘event that has transformed the relation between the cosmos, its transcendent source, and its human interpreter’. Since we are still standing in the midst of the event of modernity, shaped by the evolutionary process of and the strains and tensions within and between its three waves (humanism, Enlightenment, romanticism), Dupré underlines the necessity to move from hermeneutic to ontological questions. He even explicitly pleads for the rediscovery of a symbolic religious language in a tentative search for its ontological dimension and for a source of significance beyond the realm of human mind. The main question, however, is whether contemporary Western man is still capable of such a rediscovery. (shrink)

Three different text matching techniques were used on published Abstracts to identify redundancy candidates, and predictions were verified by reading full text versions of the redundancy candidate articles. A small fraction of the total articles in the database was judged to be redundant. This was viewed as a lower limit, because it excluded cases where the concepts remained the same, but the text was altered (...) substantially. Far more pervasive than redundant publications were publications that did not violate the letter of redundancy but rather violated the spirit of redundancy. There appeared to be widespread publication maximization strategies. Studies that resulted in one comprehensive paper decades ago now result in multiple papers that focus on one major problem, but are differentiated by parameter ranges, or other stratifying variables. This ‘paper inflation’ is due in large part to the increasing use of metrics (publications, patents, citations, etc) to evaluate research performance, and the researchers’ motivation to maximize the metrics. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. In this paper I aim to re-think the question of the world of persons with schizophrenia from the perspective of the German phenomenologist Max Scheler and that of the Japanese psychiatrist Bin Kimura. So far, no comparison between these two authors has been made, even though there are several convergences and evidence of Scheler’s indirect influence on Bin Kimura through Viktor von Weizsäcker. In recent years, Dan Zahavi, Louis Sass, and Josef Parnas have interpreted the modus vivendi of schizophrenic (...) patients in relation to a disturbance on the level of the “minimal self”. Subsequently, the discussion has highlighted the importance of disorders on the level of intercorporeality and intersubjectivity (Thomas Fuchs) and on the level of “existential feelings” (Matthew Ratcliffe). This paper argues that Max Scheler and Bin Kimura allow us to focus on an aspect which has been neglected so far: that of a “relational self” that relates to the very foundation of intersubjectivity and intercorporeality and that can thus be reborn in the encounter with the other and may position itself differently in the world. In Scheler’s perspective, the world of persons with schizophrenia is the result of an axiological disorder (valueception) that impairs contact with the primordial life impulse (Lebensdrang). As a consequence, they are incapable of attuning emotionally and socially with others: this prevents the singularity from being reborn in the encounter with the other and forces them to position themselves in their own solipsistic universe. Moving in a similar direction, Bin Kimura interprets the world of persons with schizophrenia as the result of a disorder of aida (one of the central concepts of Japanese culture that indicates the space of being in between). The disorder of aida compromises the basic relationship (Grundverhältnis in the sense of Viktor von Weizsäcker) and hinders what Bin Kimura calls festum, i.e. the birth of subjectivity, so that it is experienced by persons with schizophrenia only as ante festum. Starting from these two perspectives, I argue the existence of an axiological and anthropogenetic dimension of psychopathology. I begin with a discussion of Zahavi’s concept of minimal self and the thesis that reveals the disorders on this level of subjectivity as the origin of the world of persons with schizophrenia. I, then, analyze Max Scheler’s position and its historic importance for the emergence of phenomenological psychopathology. Thereafter, I introduce the concepts of “disorder of aida” (Bin Kimura) and “disorder of ordo amoris” (Max Scheler). Finally, I develop the concept of a “psychopathology of ordo amoris” by also comparing it with Ratcliffe’s thesis of “existential feelings”. (shrink)

Les dessins laissés par Mark Lombardi le jour de son suicide en 2000, laissent apparaître des schémas graphiques qui mettent en lien les instances du pouvoir et de l’industrie et se donnent comme une cartographie de la trame du pouvoir. En utilisant le graphe Lombardi s’inscrit dans la suite des avant-gardes européennes qui de Steiner à Beuys, de Debord à Estivals avaient tentées de telles restitutions, en cela il semble être un aboutissement. Dans ce travail il y aurait (...) comme une sauvegarde de l’art qui retrouverait une fonction de vérité. Celle-ci est celle qui révèle la porte du pouvoir devant laquelle l’art nous conduit. Louis G. Lombardi’s arguments in support of the claim that humans have greater inherent worth than other living things provide a clear account of how it is possible to conceive of the relation between humans and nonhumans in this way. Upon examining his arguments, however, it seems that he does not succeed in establishing any reason to believe that humans actually do have greater inherent worth than animals and plants.

L’une des tâches centrales de la théorie politique normative est d’imaginer et de défendre des alternatives plus justes au système économique et social actuel. Dans ce but, les chercheurs et chercheuses doivent nécessairement spéculer sur la nature des scénarios alternatifs possibles, mais encore inexistants. Grâce à l’étude d’une branche relativement récente de la théorie politique contemporaine (la théorie politique de la finance), cet article vise à étudier une question générale : Quelle doit être l’attitude du chercheur ou de la chercheuse (...) face aux nécessaires incertitudes empiriques inhérentes à sa tâche? En chemin, l’article identifie trois problèmes principaux auxquels fait face la littérature : un manque de clarté et de rigueur dans la définition des alternatives étudiées, un niveau élevé d’incertitudes concernant les effets attendus de ces alternatives, et une relation problématique entre le choix de l’alternative défendue et l’évaluation normative du statu quo. L’article se conclut par plusieurs recommandations visant à remédier à ces problèmes. (shrink)

New technologies have the potential to severely “challenge” or “disrupt” not only our established social practices but our most fundamental concepts and distinctions like person versus object, nature versus artificial or being dead versus being alive. But does this disruption also change these concepts? Or does it merely change our operationalizations and applications of the same concepts? In this paper, I argue that instead of focusing on individual conceptual change, philosophers of socially disruptive technologies (SDTs) should think about conceptual change (...) as a change in a network of interrelated concepts. What really generates a potential social disruption are changes of inferential relations between concepts – whether or not this entails a change of the respective individual concepts. Philosophers of socially disruptive technologies are therefore in the privileged position of being able to avoid commitments regarding the individuation of individual concepts. -/- . (shrink)

Empathy remains poorly understood, under-theorized, and subject to conflicting and opportunistic uses. Its systematic role in human experience has not been analyzed and interpreted from top to bottom. In this book, the author attempts to provide such an analysis in the philosophical traditions of hermeneutics, phenomenology, analytic philosophy of language, and psychoanalysis. applying his interpretation of empathy to the philosophical issues of intentionality, the emotions, and the checkered transformations of empathy itself. In doing so the author aims to rescue empathy (...) from the margins of intelligibility and reveal its central role in our understanding of the emotions, the integrity of our relations with others, and human community (“intersubjectivity”). -/- The work draws on both the Anglo-American (“analytic”) tradition of ordinary language philosophy and the continental ones of phenomenology and hermeneutics. This work follows the movement of empathy from the periphery of ethics, aesthetics, and theory of mind to a key place in establishing and maintaining the integrity and emotional equilibrium of dynamic interrelations with other individuals. Beginning with the philosophical infrastructure of the hermeneutics of empathy, this work thoroughly explains the complex architecture of empathy, tracing it downward through the levels of authentic human interrelations, empathy with unexpressed emotions, the empathic penetrability of cognitively impenetrable affect, the first-ever intentional analysis of both the empathizer and the “empathasand” in interrelation, and the hermeneutic infrastructure. The consequences of empathy are exposed in the context of the emotions, cognitive impenetrability, empathy and altruism, and the intentionality of empathy as accessed through language and story telling. Drawing on the multi-method approach of hermeneutics, phenomenology, and story telling, this work demonstrates that empathy forms the foundation for community in ways not clearly appreciated in the on-going debate. In a bootstrap operation that is guided by Heidegger’s call for a “special hermeneutic of empathy,” this work achieves a delicate balancing act of unpacking the rich intellectual traditions from which empathy - the phenomenon itself, not the concept - emerged historically. The result is an exposure of the deep structure of empathy as a fundamentally human capability for creating possibilities of community and human relations. (shrink)

In this paper I link two hitherto disconnected sets of results in the philosophy of emotions and explore their implications for the computational theory of mind. The argument of the paper is that, for just the same reasons that some computationalists have thought that cognition may be a natural kind, so the same can plausibly be argued of emotion. The core of the argument is that emotions are a representation-governed phenomenon and that the explanation of how they figure in behaviour (...) must as such be undertaken in those terms. I conclude with some interdisciplinary reflections in defence of the hypothesis that emotions might be more fundamental in the organization of behaviour than cognition; that, in effect, we may be emoters before we are cognizers . The aim of the paper is: (1) to introduce a number of promising results in philosophical and empirical emotion theory to a wider audience; and (2) to begin the task of organizing those results into a computational theoretical framework. It is widely assumed that G. E. Moore was either oblivious or indifferent to circularity worries surrounding his enigmatic proof of an external world. I argue that this assumption is false. Drawing on unpublished archival evidence and overlooked passages in Moore’s posthumously published lectures, I provide, for the first time, an account of Moore on circular proof. I show that, as early as 1928–29 and as late as 1938–39, Moore identified an “important” and “unimportant” sense of begging the question (epistemic (...) circularity and premise circularity, respectively) and maintained that a genuine proof should avoid both forms. Curiously, however, this standard is not upheld in his 1939 “Proof,” where this “important” sense is conspicuously absent from Moore’s discussion. This discrepancy raises an interpretative puzzle: Why does Moore’s standard for proof change? I provide an answer and explore its philosophical implications, clarifying the paradoxical nature of the proof and re-diagnosing the sense of intellectual dissatisfaction experienced by many commentators. In the literature, there are many axiomatizations of qualitative probability. They all suffer certain defects: either they are too nonspecific and allow nonunique quantitative interpretations or are overspecific and rule out cases with unique quantitative interpretations. In this paper, it is shown that the class of qualitative probability structures with nonunique quantitative interpretations is not first order axiomatizable and that the class of qualitative probability structures with a unique quantitative interpretation is not a finite, first order extension of the theory (...) of qualitative probability. The idea behind the method of proof is quite general and can be used in other measurement situations. (shrink)

Dans cet article je présente et discute l'ouvrage de Roberta Dreon, Human Landscapes: Contributions to a Pragmatic Anthropology (Suny Press, 2022). Je le fais à partir de deux questions. La première concerne les avantages d'une anthropologie pragmatiste par rapport à des tentatives similaires, inspirées soit de la phénoménologie post-husserlienne (notamment les recherches actuelles sur le caractère incarné de l'esprit et de la cognition), soit de l'herméneutique philosophique. La seconde question porte sur la contribution possible d'une anthropologie philosophique à une critique (...) culturelle, c'est-à-dire à la critique d’erreurs, de confusions, et d’illusions existant dans notre manière moderne de penser, dans les idéaux que nous nous sommes donnés, dans nos habitudes collectives et dans nos “imaginaires sociaux.”. Although during the last decades the philosophy of chemistry has greatly extended its thematic scope, the main difficulties appear in the attempt to link the chemical description of atoms and molecules and the description supplied by quantum mechanics. The aim of this paper is to analyze how the difficulties that threaten the continuous conceptual link between molecular chemistry and quantum mechanics can be overcome or, at least, moderated from the perspective of BM. With this purpose, in “The quantum-mechanical challenges” section (...) the foundational incompatibility between chemical and SQM descriptions will be briefly recalled. “Bohmian mechanics” section will be devoted to explain the main features of BM. In “Empirical equivalence and underdetermination” section, the consequences of the empirical equivalence between SQM and BM will be discussed. Finally, in the Conclusion, we will stress the scope of the obtained conclusions and the philosophical difficulties that still remain even after adopting BM for foundational purposes. (shrink)

Historia, as both a type of critical inquiry and a source of information about nature and the human world, is a key category in Spinoza’s Tractatus theologico-politicus. In this work, the Latin word cannot be simply and invariably translated as “history,” not even if we add the proviso that its meaning wavers inevitably between “history” and “story,” for its semantic range is too broad and complex. At the two ends of the semantic spectrum we have the impartial report, on the (...) one hand, and the creations of sheer fantasy, on the other. Historia may therefore denote the detached observation of nature and the philological analysis of a text, but it can also refer to the free exercise of the imagination in a variety of narrative contexts. While Spinoza denies that the inquiry resulting from historia and its products may have true cognitive value, he acknowledges that historia plays a fundamental role in society and politics. The reason is that historia and the imagination are bound up together by a special relationship. This is apparent at all levels of the historical engagement with reality, but is particularly true in the case of religion, moral norms and belief systems, for in this variegated domain the link between imagination and historia functions as the connective tissue that keeps societies united and functioning. This specific nexus of imagination and historia is Spinoza’s original contribution to the early modern notion of “moral certainty.” More importantly, it is only at this level that Spinoza grants a modicum of intelligibility to the ‘historical’ productions of the imagination, be they signa, revelationes, or even nugae. The fact remains, though, that to a certain extent humans keep having a distorted grasp of reality, indeed hallucinate, even when their ‘historical’ accounts of reality are socially and politically productive. Here the key element is the notion of fictional continuity based on a socially constructed trust in narrative accounts of reality: the imagination turns reality into stories, but in so doing it keeps the otherwise constitutively hallucinatory nature of humans at bay and under control. Perceptibilitas, that is, the ability to provide acceptable cognitive solutions between intelligible knowledge and moral certainty, is ultimately what defines the contribution of the imagination to the human work of knowledge. While the theory of public goods points to socially suboptimal contributions by agents acting under Cournot assumptions, this externality can be rectified by the introduction of positive interdependence of actions to the individual's choice calculus. This paper draws attention to the fact that the institution of democratic voting is itself a means of transforming the individual calculus in such a way that parameter changes are evaluated as simultaneous adjustments by the group, on the side of benefits, but by the individual (...) only, on the side of costs, thus generating optimal parameter preference in the case of identical agents. The first publication of seminal early writing by Louis Althusser. Throughout the 1960s and 1970s, Louis Althusser enjoyed virtually unrivalled status as the foremost living Marxist philosopher. Today, he is remembered as the scourge and severest critic of "humanist" or Hegelian Marxism, as the proponent of rigorously scientific socialism, and as the theorist who posited a sharp rupture—an epistemological break—between the early and the late Marx. This collection of texts from the period 1945-1953 turns these interpretations of Althusser (...) on their head: we discover that there was a "young Althusser" as well as the "mature Althusser" we are already familiar with. In his fascinating Master's thesis, "On Content in the Thought of G.W.F. Hegel" (1947), Althusser developed a position which he was later to attack ferociously: namely, that the revolutionary potential of the Hegelian dialectic could be defended against Hegel's own political conservatism. We see Althusser still wrestling with the spectres of Hegel and of Catholicism in another long text, his letter to Jean Lacroix, and, finally, we see his own "epistemological break" in the piece "On Marxism" from 1953. Other texts included are his critique of Alexander KojÅve (whose interpretation Francis Fukoyama has recently revived) and his attack on the French Church's teachings on women, sex and the family. Widely recognized as an intellectual giant of the late twentieth century, Althusser has left a towering legacy. This collection not only gives a unique insight into the formation of such a personality, but will also restore the "unknown Althusser" to the centre of the history of Marxism and of philosophy since the Second World War.
